The Photographer agrees to provide photography services as outlined in the specific service package chosen by the Client. This includes, but is not limited to, [list services: e.g., event photography, portraits, weddings, photo booth rental etc.], at the agreed-upon location(s) and date(s).

a) Booking Confirmation: A signed contract and a non-refundable deposit of 50% of the total service fee are required to confirm the booking. This deposit is applied to the total cost of services.

b) Full Payment: The remaining balance is due no later than 24 hours prior to your session

c) Accepted Payment Methods: Payments may be made via debit card or credit card

d) Late Payment: Failure to pay the full amount by the due date may result in the cancellation of services or additional charges.

a) Client Cancellation: Cancellations made less than 72 hour before the scheduled session will result in a $50 inconvenience fee.

b) Photographer Cancellation: In the event the Photographer is unable to perform the services due to illness, emergencies, or other unforeseen events, a full refund of any payments made, including the deposit, will be issued.

c) Rescheduling: The Client may reschedule the session if notice is provided 72 hours prior to the session, subject to availability. A $50 rescheduling fee will apply if less than 72 hours.

d) No-Show Policy: If the Client does not show up to the session at the scheduled time and location, no refunds will be issued, and the full amount will be charged to the card.

a) Copyright: The Photographer retains full copyright over all images taken during the session.

b) Client Usage: The Client is granted a non-exclusive, non-transferable license to use the images for personal purposes only, such as social media sharing, prints, and personal projects. Commercial use, including publication, reproduction, or distribution of images, is prohibited unless specifically granted in writing.

c) Photographer Usage: The Photographer reserves the right to use images for promotional purposes, including but not limited to portfolios, social media, websites, and marketing materials.

d) Model Release: By booking a session, the Client grants the Photographer permission to use images of themselves, their family, or their guests for promotional purposes unless explicitly declined by the Client in writing.

a) Location & Permits: The Client is responsible for obtaining any necessary permits or permissions for the location of the shoot.

b) Punctuality: The Client is expected to be on time for the session. Late arrivals may result in a shortened session without a reduction in the agreed-upon fee.

c) Cooperation: The Client agrees to cooperate with the Photographer during the session and follow reasonable instructions. If the session is disrupted by the Client or their guests, the Photographer reserves the right to terminate the session without a refund.

d) Model Release for Others: If the session involves other individuals, the Client is responsible for obtaining necessary permissions and model releases for all persons featured in the photographs.

a) Editing & Retouching: The Photographer will provide edited images as part of the service package. Any requests for specific edits or additional retouching may incur extra charges.

b) Delivery Timeframe: The Photographer will deliver the final edited images to the Client within 7-10 days for portrait sessions, 3-5 days for events, 4 weeks for weddings, and 2-4 days for photo booth rentals unless otherwise agreed upon.

c) File Delivery: Images will be delivered via an online gallery according to the agreed method.

a) Limitation of Liability: The Photographer is not responsible for any injury, accident, or damage to property or persons that occurs during the photoshoot. The Client assumes all risk associated with the session.

b) Equipment Damage: The Client is financially responsible for any damage caused to the Photographer’s equipment during the session by the Client or their guests.

c) Force Majeure: The Photographer is not liable for failure to provide services due to events outside of their control, including natural disasters, illness, or other unforeseen circumstances.

a) Data Collection: The Photographer may collect personal information such as the Client’s name, email address, and payment details. This information will be used solely for the purpose of providing photography services and will not be shared with third parties without the Client’s consent, except as required by law.

b) Image Privacy: Clients may request that certain images not be shared publicly. While the Photographer will make reasonable efforts to honor such requests, this request must be communicated in writing prior to or during the session.

a) Travel Fees: Travel fees may apply for sessions outside a defined radius of the Photographer’s location, based on distance and time.

b) Additional Services: Any additional services, such as extra hours, albums, prints, or other customized requests, will be billed separately at agreed-upon rates.

c) Satisfaction: If the Client is dissatisfied with the final images, they must notify the Photographer within 48 hours of receiving the images to discuss any concerns and possible resolutions.

This Agreement shall be governed by and construed in accordance with the laws of the state/province of North Carolina & Georgia Any legal action related to this Agreement must be filed in the appropriate court in North Carolina & Georgia.

The Photographer reserves the right to modify these Terms and Conditions at any time. All modifications will be posted on this page, and any changes will be effective immediately upon posting. It is the Client’s responsibility to review these terms periodically.
